2.2 The Estate comprises various properties, landholdings, accommodation units, event venues, and associated services.

3. Access to the Website
3.1 Access to the Website is provided on a temporary basis. We reserve the right to withdraw, suspend, or amend the Website without notice.
3.2 We do not guarantee that the Website, or any content on it, will always be available or uninterrupted.
3.3 You are responsible for ensuring that all persons accessing the Website through your internet connection are aware of these Terms and comply with them.
4. Acceptable Use
4.1 You may use the Website only for lawful purposes.
4.2 You must not:
- use the Website in any manner that breaches applicable law.

- Event bookings (e.g., weddings, corporate events, private functions) are governed by separate contractual terms.
- The Estate reserves the right to refuse or cancel bookings where necessary for operational, safety, or legal reasons.
8.3 Activities and Land Access
- Access to Estate land for walking, photography, sporting activities, or other purposes may require prior permission.
- Users must comply with all signage, safety instructions, and applicable Scottish outdoor access laws.
- The Estate may restrict access during events, maintenance, or adverse conditions.
9. Payments
9.1 Payments for services must be made in accordance with the terms provided at the time of booking.
9.2 We reserve the right to revise prices at any time prior to confirmation.
9.3 Failure to make payment may result in cancellation of services.

10.1 The Website may contain links to third-party websites. These links are provided for convenience only.
10.2 We do not endorse, control, or accept responsibility for third-party content, privacy practices, or services.

Rosebery Estates – Venue Hire Terms & Conditions
Applies to all venue bookings across Rosebery Estates, including Rosebery Steading, Rosebery House, and Barnbougle Castle.
1. Your Contract with Us
When you submit a Booking Form, you enter into a contract with Rosebery Estates Partnership for the hire of one of our venues. These Terms & Conditions, together with the Booking Form and the Venue Rules, form the full agreement.
You are responsible for ensuring that all guests, suppliers, and contractors attending your event are aware of and follow these Terms & Conditions.
2. Access to the Venue
- You and your approved suppliers may access the venue during the agreed hire period.
- Supplier details must be provided at least 5 business days before the event.
- Rosebery Estates may refuse access to any supplier acting unreasonably or unsafely.
- Certain areas of each venue are restricted and must not be entered.
- Venue capacities vary by location (see Venue Annexes).
3. Payments
Your Booking Form will set out the venue fee and payment schedule. In general:
- A deposit is required when you sign the Booking Form.
- Further instalments are due before the event (timing varies by venue).
- A refundable security deposit may be required.
- All invoices must be paid within 14 business days.
- You remain responsible for all payments, even if a third party contributes.
4. Your Responsibilities
During your Hire Period, you agree to:
- Follow all Venue Rules and ensure your guests and suppliers do the same.
- Use only the areas included in your booking.
- Ensure entertainment is approved in writing at least 10 business days before the event.
- Avoid any activity that breaches licensing laws, safety rules, or emergency procedures.
- Pay for any damage caused to buildings, grounds, furniture, or equipment.
- Vacate the venue at the agreed time; late departure may incur additional charges.
- Confirm your ceremony arrangements (registrar, celebrant, minister) directly.
- Notify us of any accessibility needs at least 14 days before the event.
- Hold public liability insurance for the minimum amount stated in your booking form and provide proof on request.
5. Changes or Cancellations by You
If you need to amend your booking:
- Changes must be requested as early as possible and no later than 6 weeks before the event.
- Late changes may incur additional charges and cannot be guaranteed.
If you cancel your booking:
- Cancellation must be made in writing.
- Your deposit is non‑refundable.
- Additional cancellation charges may apply depending on how close to the event the cancellation occurs (details provided in your Booking Form).
- We will always try to re‑let the date; if successful, we may refund part of your payments at our discretion.
Pandemic / Government Restrictions: If government restrictions prevent your event from taking place or significantly reduce attendance, you may request to reschedule within 12 months at no extra cost. If no suitable date is available, we will refund all payments except any irrecoverable costs already incurred.
6. Changes or Cancellations by Rosebery Estates
We may need to amend or cancel a booking if:
- A Force Majeure Event occurs (e.g., severe weather, fire, national emergency).
- Part of the venue becomes unavailable.
- You fail to pay invoices on time.
- You breach the Terms & Conditions or Venue Rules.
- You become insolvent or bankrupt.
If we must cancel for reasons beyond your control, we will refund all payments made (except where your deposit is stated as non‑refundable for that venue).
7. Liability
- Rosebery Estates is not responsible for loss, damage, or theft of personal belongings or vehicles.
- All vehicles and property are left entirely at the owner’s risk.
- Nothing in these Terms limits our liability for death or personal injury caused by our negligence or for fraud.
8. Data Protection
We will handle your personal data in accordance with UK data protection legislation.
9. Other Important Information
- This contract does not create a partnership between you and Rosebery Estates.
- You may not transfer or assign your booking to another person.
- Any changes to your contract must be agreed in writing.
- Scottish law applies, and disputes will be handled by the Scottish courts.
- Only the parties named in the contract have rights under it.
Annexxe A — Rosebery Steading
- Capacity: Up to 100 guests (with accommodation limits per cottage).
- Restricted Areas: Plant room, kitchen, bar store, electrical room.
- Payment Schedule: 25% on booking, 25% at 9 months, balance at 2 months.
- Security Deposit: £1,000 + VAT.
- Late Departure Fees: £500/hr (event spaces), £1,000/hr (accommodation).
Annexxe B — Rosebery House
- Capacity: Up to 60 guests.
- Restricted Areas: Bedrooms, attic, wine cellar, office, private storage areas.
- Payment Schedule: 50% on booking, balance 8 weeks before the event.
- Parking: Maximum 10 vehicles.
- Late Departure Fee: £500/hr.
Annexxe C — Barnbougle Castle
- Capacity: As specified in the Booking Form (typically 120–200 depending on layout).
- Restricted Areas: Private family areas, offices, storage rooms, and any areas marked as staff‑only.
- Payment Schedule: As set out in the Barnbougle Booking Form (usually deposit + staged payments).
- Additional Requirements:
- All suppliers must be approved in advance.
- Fireworks, drones, and open flames require written permission.
- Deliveries and collections must follow the Castle’s access schedule.
- Late Departure Fee: As specified in the Booking Form.
